Plan de estudios

Students will be provided with the terminology used in the area of Criminal Law and Criminal Procedure. The course has two clearly defined stages.
Firstly, a brief theoretical summary will be provided to deal with the main concepts around which the translation workshop will evolve.
Secondly, time will be devoted to the analysis of documents written in English as a source language. This will allow students to see the analyzed terminology in action and to understand the text register and style. Afterwards, the documents will be further reviewed to analyze the grammar and syntax of each particular document as a pre-translation task.
Special attention will be paid to the semantic field in the understanding that translation is a semantically driven task. Meaning, collocations and usage are going to be addressed as part of the translation process. False cognates are going to be reviewed to avoid common negative transfers that lead to frequent mistakes by Spanish native speakers.
The course will deal with different translation techniques (Functional Vs. Literal approach). During the course, students will be encouraged to develop a translation protocol to standardize the translation process in an attempt to avoid mistakes and to enhance translation quality standards.
Temario:
CRIMINAL PROCEDURE
Classification of crimes (felonies, misdemeanors, etc.), different kinds of crimes
Constitution: Amendments
Arrest (with warrant, without warrant), civil arrest. Stop and frisk procedures. Search warrant, fruits of illegal searches. The fruit of the poisonous tree doctrine. Procedure at the police station (booking, fingerprinting).
Procedure in court: Appearance before a magistrate, setting of bail, recognizance. Indictment, information. Procedure before a Grand Jury. Arraignment. Plea: Guilty, not Guilty, Nolo Contendere.
Defenses in criminal actions.
Different stages during the trial in open court.
Verdict. Sentence. Probation. Parole.
Similarities and differences in the criminal process in the two systems.
Analysis of the procedure used in courts both in the Federal Capital and in the Province of Buenos Aires.
Each procedural step will be illustrated by a specimen document in order to entail a proper comparative analysis and a subsequent translation.
